Quick answer. The negative certificate confirms the availability of a business name, acronym or sign for registration in the commercial register. It does not create the company by itself and it does not automatically protect the chosen name as a trademark.
What is the negative certificate for?
OMPIC presents the negative certificate as one of the first steps in creating a commercial business. For a legal entity it is part of the initial formalities. For some individual traders, the need may depend in particular on whether a commercial sign is used.
OMPIC’s FAQ states that an application involves the appropriate form and payment of the applicable fees. The certificate reserves the approved name for a limited period so that the remaining incorporation and registration steps can be completed.
Business name, sign and trademark are different
| Element | Purpose |
|---|---|
| Business/company name | Identifies the business for registration purposes |
| Commercial sign | Identifies a commercial establishment |
| Trademark | Protects a sign for specified goods or services under industrial-property rules |
OMPIC explicitly warns that a negative certificate is not a substitute for trademark registration. If commercial protection of the name matters to your project, review the trademark route separately.
Online application and tracking
OMPIC now directs users to the negative-certificate service on DirectEntreprise. After filing, the status of an application can be tracked online. If the request is rejected, OMPIC’s FAQ describes a specific follow-up procedure; do not automatically submit a new application before checking the rejection reason and the correct route.

Key point: the certificate reserves a name so creation can continue; it is neither final company registration nor a trademark title.
